Inventory Purchase Agreement

Shipping & Delivery

Orders are processed within 5 business days of purchase, excluding weekends and holidays. Once an order has shipped, tracking information will be provided via email.

Shipping Fees

Shipping fees are calculated at checkout and are nonrefundable.

Risk of Loss

Risk of loss passes to the purchaser upon delivery of the item to the shipping carrier for shipped items, and upon delivery to the consignor or its designated representative for local pickup. The Porter's Daughter is not responsible for packages lost, delayed, or damaged by the carrier once shipped.

Local Pickup

Local pickup is available at our Hattiesburg, Mississippi location for eligible orders. Orders not picked up within 10 days may be canceled at The Porter's Daughter's sole discretion.


All Sales Final

Due to the nature of consignment and resale, all sales are final. The Porter's Daughter does not accept returns, refunds, or exchanges except where required by applicable law.

We encourage thoughtful purchasing and provide detailed descriptions, measurements, and condition notes to support informed decisions.

Reconsigning Option

If a purchased item does not work out, purchasers are welcome to reconsign the item with The Porter's Daughter at any time, subject to our then-current consignment terms and conditions. Reconsigned items are treated as new consignments and are not eligible for refunds or store credit related to the original purchase price.


Item Condition & Final Sale Acknowledgment

All items sold by The Porter's Daughter are pre-owned unless otherwise stated. By completing a purchase, the Purchaser acknowledges and agrees that:

  1. Purchaser has had a full and fair opportunity to review all available information regarding the item(s), including measurements, photographs, descriptions, and any disclosed imperfections or wear.
  2. The Purchaser accepts the item(s) in "as is" and "as available" condition, with all faults, whether apparent or not, to the fullest extent permitted by law — fully recognizing items may show signs of wear consistent with their listed condition.
  3. The Purchaser agrees that the provided measurements, photographs, and descriptions are adequate for making an informed purchasing decision, and no further representations or warranties have been relied upon.
  4. Variations in color, texture, fit, and appearance may occur due to lighting, screen display differences, manufacturing tolerances, wear, or fabric characteristics, and such variations shall not constitute a defect or misrepresentation.
  5. The Purchaser assumes all risk of dissatisfaction regarding fit, sizing, or aesthetic preferences after purchase.

Authenticity & Dispute Procedure

The Porter's Daughter is committed to offering authentic, high-quality merchandise. Luxury handbags and certain select designer items are authenticated using trusted third-party services, including Entrupy and/or LegitGrails, when applicable. Authenticated items will be identified as such prior to purchase.

Notice Requirement

Any claim alleging that an item is not authentic must be submitted in writing to help@theportersdaughter.com within 7 calendar days of confirmed delivery. Failure to provide written notice within this period constitutes final acceptance of the item's authenticity and a waiver of all related claims, except where otherwise required by applicable law.

Burden of Proof

The Purchaser bears sole responsibility for substantiating any authenticity claim. All claims must be supported by credible, verifiable documentation from a qualified, independent expert or recognized authentication service acceptable to The Porter's Daughter in its sole discretion. The Porter's Daughter shall not be bound by the opinion of any third-party authenticator not expressly approved in advance.

Our Rights & Discretion

The Porter's Daughter reserves the absolute right, in its sole discretion, to: re-authenticate the item using an authenticator of its choosing; require the Purchaser to submit additional information, photographs, or documentation; and/or determine the validity of any claim based on its internal standards and expert review.

Return Condition Requirement

If a claim is provisionally accepted for review, the Purchaser must return the item in the exact condition in which it was received, including all original tags, packaging, and accessories. Any alteration, wear, damage, or modification after delivery shall void the claim.

Final Determination

All authenticity determinations made by The Porter's Daughter, including those based on third-party authentication, shall be final and binding to the fullest extent permitted by law. Differences in opinion between authenticators, market speculation, or unverifiable claims shall not constitute sufficient grounds for a successful authenticity claim.

Inauthenticity Remedy

If an item is determined to be inauthentic, the Purchaser's sole remedy will be a refund of the purchase price. If the item is returned to the Purchaser because it is found to be authentic, return shipping shall be paid by the Purchaser.


Fraud Prevention

The Porter's Daughter reserves the right to refuse, cancel, or limit orders that appear to be fraudulent, abusive, or placed in bad faith. This includes, but is not limited to:

  • Chargeback abuse
  • False claims regarding item condition or authenticity
  • Suspicious purchasing or return behavior

Accounts engaging in fraudulent activity may be permanently restricted.


Pricing & Availability

All prices are subject to change without notice. Inventory is limited to one-of-a-kind and similar items, and availability is not guaranteed until checkout is complete.

The Porter's Daughter is not responsible for typographical pricing errors and reserves the right to cancel orders affected by such errors.


Sales Tax

Applicable sales tax will be calculated and collected at checkout based on shipping destination and local regulations.


Limitation of Liability & Disclaimer of Warranties

To the fullest extent permitted by law, The Porter's Daughter shall not be liable for indirect, incidental, or consequential damages arising from the purchase, sale, or use of any product sold. In no event will The Porter's Daughter's liability exceed the amount actually received as a result of selling inventory to Purchaser.

The Porter's Daughter's services are provided on an "as is" and "as available" basis. All implied warranties, including merchantability and fitness for a particular purpose, are expressly disclaimed to the extent permitted by applicable law.

The Porter's Daughter will not be liable for damages arising from: (a) use or inability to use its services or website; (b) unauthorized access to or alteration of Purchaser's data; (c) activities contemplated by this Agreement; or (d) any other matter relating to its services.


Dispute Resolution

All disputes will be resolved first through good-faith negotiation, then mediation in Hattiesburg, Mississippi, and finally through binding arbitration — not in court. By purchasing, you waive your right to a bench or jury trial and to participate in class actions.

Amicable Resolution

Notify The Porter's Daughter of any dispute by email at help@theportersdaughter.com, describing the nature of the dispute and the relief sought. The parties will have 60 days to resolve the matter informally.

Mediation

If unresolved after 60 days, the dispute may be submitted to mediation in Hattiesburg, Mississippi, with a Mississippi-licensed attorney acting as mediator.

Binding Arbitration

If mediation is unsuccessful, disputes will be resolved by binding arbitration administered under the AAA Consumer Arbitration Rules, conducted in Forrest County, Mississippi, by a single arbitrator. The arbitrator's decision is final and binding.

Governing Law

This Agreement is governed by the laws of Mississippi. Any matters not subject to arbitration will be resolved exclusively in the state or federal courts of Mississippi sitting in Forrest County.


General Provisions

Amendments

The Porter's Daughter may update these terms at any time at its sole discretion. Purchasers agree to be bound by all revised terms on the effective date.

Severability

If any provision of this Agreement is found void or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

This Agreement sets forth the final, complete, and exclusive agreement between the Purchaser and The Porter's Daughter regarding the subject matter hereof, superseding all prior understandings or agreements.

Survival

Any provision that imposes continuing obligations on either party will survive termination of this Agreement.

Notices

All notices must be in writing and sent to help@theportersdaughter.com. The Purchaser is solely responsible for keeping their contact information current and accurate.
